MICKENS v. TAYLOR, 00-9285

In order to demonstrate a Sixth Amendment violation where the trial court fails to inquire into a potential conflict of interest about which it knew or reasonably should have known, a defendant must establish that the conflict adversely affected his counsel's performance; here, even though defendant's counsel represented the victim in a previous case and did not notify the defendant, court or co-counsel of the potential conflict, no violation found.
