Martin v. US, 17-2224

Affirmed that a Fifth Amendment takings claim was not ripe in a case where the plaintiffs alleged that the U.S. government had caused a compensable taking by barring repairs to forest-fire-damaged roads which provided the only means to access their patented mining and homestead claims within the Santa Fe National Forest. In finding that their regulatory taking case was not yet ripe for review, the appeals court noted that plaintiffs had not yet applied for a permit to reconstruct the forest roads.
