Vacated and remanded a decision of the Trademark Trial and Appeal Board dismissing plaintiffs opposition to the registration of defendants trademarks including the term ZERO. The Federal Court of Appeals determined that the Board erred in legal framing of the question and failed to determine whether the marks were at least highly descriptive.
