In Re: Wang, 17-1827
Appeal from the Patent Trial and Appeal Board which rejected certain patent claims as directed to non-statutory subject matter under 35 USC section 101. Plaintiff sought to patent a different phonetic symbol system that mapped letters to sounds. Court of Appeals affirmed the rejection stating that a patent is available per section 101, if it is a process, machine, manufacture or composition of matter, or an improvement thereof. Further, it must be in a physical or tangible form.
