United States Federal Circuit

Acree v. O'Rourke, 17-1749

Vacating and remanding the US Court of Appeals for Veterans Claims affirmation of a Board of Veterans' Appeals decision dismissing seven claims arising from the post-traumatic stress disorder suffered by an Iraq war veteran who claimed that his withdrawal of claims was not shown to have been explicit, unambiguous, and done with a full understanding of the consequences of such action on the part of the claimant where the veteran asserted that his history of taking psychotropic medications should have resulted in a hearing officer's inquiry into whether he had the capacity to understand the consequences of dismissing the claims.
