Energy Heating, LLC v. Heat on the Fly, LLC, 16-1559
Affirming a declaratory judgment holding water heating apparatus patents unenforceable due to inequitable conduct and of tortious interference and denial of remedies under the North Dakota Unlawful Sales or Advertising Practices Act, but vacating the denial of attorney fees and remanding on that issue alone in a case where the patent holder hid transactions from the Patent and Trademark Office that would have potentially triggered the on-sale bar.
