United States Federal Circuit
Apator Miitors APS v. Kamstrup A/S, 17-1681
Affirming the Final Written Decision of the US Patent and Trademark Office Patent Trial and Appeal Board in an inter partes review of a patent on an ultrasonic consumption meter that was anticipated by one patent and rendered obvious in light of another because the owner of the voided patent could not swear behind the owner of the anticipating patent by showing conception and reduction to practice prior to their filing date where substantial evidence supported the Board ruling that the owner failed to sufficiently corroborate the testimony of conception by the alleged inventor.
