Bly v. Shulkin, 17-1287

Vacating and remanding an application for attorney fees and expenses requested under the Equal Access to Justice Act denied by the Court of Appeals for Veterans Claims which determined the application was untimely when it was filed 31 days after the decision was rendered because an applicant has thirty days from a final decision and Veterans Court decisions are appealable for 60 days after judgment is entered, meaning that his application was still timely.
