United States Federal Circuit

Parkinson v. Department of Justice, 15-3066

Vacating the portion of a Merit Systems Protection Board decision sustaining a man's removal from the Federal Bureau of Investigation that indicated that FBI employees may raise whistleblower reprisal as an affirmative defense before the Board, but reinstating the panel opinion as to all other issues because the law requires all FBI employees to bring claims of whistleblower reprisal to the Attorney General.
