United States Federal Circuit

Rovalma, S.A. v. Bohler-Edelstahl GmbH & Co. KG, 2016-2233

In an appeal of inter pates review of a patent that describes and claims methods for making steels with certain desired thermal conductivities, the Patent Trial and Appeal Board's decision, rejecting petitioner's construction and determining that the claims would have been obvious to a relevant skilled artisan over the same prior art that petitioner invoked, is vacated where, because the Board did not set forth its reasoning in sufficient detail to determine what inferences it drew from the patent owner's submissions, the court cannot determine whether the Board's decision was substantively supported and procedurally proper.
