In an infringement action involving a patent which describes a system and method for using a 'graphical indicator' (e.g., a matrix of small dots) to encode information on the surface of an object, the district court's grant of summary judgment to defendant that the claims are invalid for indefiniteness is reversed where the term 'visually negligible' did not render the asserted claims indefinite under 35 U.S.C. section 112.
