Int'l Custom Prods., Inc. v. US, 2016-1024
In an attorney's fees portion of an international trade case involving classification of certain white sauce imports under the Harmonized Tariff Schedule of the United States (HTSUS), the U.S. Court of International Trade (CIT) awarding attorney fees to plaintiff pursuant to the Equal Access to Justice Act (EAJA), 28 U.S.C. section 2412(d)(1)(A), is affirmed over the Government's challenge where the CIT did not abuse its discretion in its determinations on whether the Government's position was 'substantially justified.'
