US v. Doe, 15-10063
Sentence and conviction of aggravated identity theft, in violation of 18 U.S.C. section 1028A, are affirmed where: 1) evidence of a defendant's repeated submission of false identifying information as part of successful applications to a government agency is sufficient to permit a reasonable jury to find that the defendant knew that the information belonged to a real person, as required to prove a violation of section 1028A; and 2) the 78 -month sentence, imposed after an upward variance from the 18-to-24 month Guidelines range, was not substantively unreasonable.
