REG Synthetic Fuels, LLC v. Neste Oil Oyj, 15-1777

In an appeal arising from a petition for inter partes review filed against certain claims of a patent directed to paraffin compositions containing primarily even-carbon-number paraffins and methods of making them, the District Court's finding that the claims are unpatentable, as anticipated by two separate patents, and exclusion of defendant's evidence are: 1) affirmed in part, where certain claims were anticipated; 2) reversed in part where other claims were not anticipated; and 3) vacated in part as to the Board's determination to exclude certain exhibits for failure to consider its non-hearsay purpose and for hearsay.
