Abbot GMBH & Co. KG v. Yeda Research and Development Co., Ltd., 2015-1662
In an appeal of two District Court decisions reviewing determinations by the Board of Patent Appeals and Interferences regarding Yeda's assertion that Abbot's '915 patent, which discloses a protein referred to as TBP-II, is invalid as anticipated the District Court's judgments are: 1) affirmed as to the 2015 decision that Abbot's '915 patent is supported by the written description of the '072 application; and 2) dismissed as to the 2008 decision as moot.
