In an appeal of inter partes review of claims of a patent that relates to spinal surgery that inserts an artificial implant between two adjacent vertebrae from a patient's side, the Patent Trial and Appeal Board's findings of invalidity are: 1) affirmed in part where substantial evidence supports the PTAB's findings as to certain prior art and the motivation to combine prior art references; and 2) vacated in part where the PTAB did not adequately explain how certain prior art discloses claim 17's 'Elongated Portions' limitation.
