Halo Electronics, Inc. v. Pulse Electronics, Inc., 2013-1472
In an infringement action on remand from the U.S. Supreme Court involving patents directed to surface mount electronic packages containing transformers for mounting on a printed circuit board inside electronic device such as computers and internet routers, the District Court's summary judgment that defendant did not sell or offer to sell within the U.S. the accused products that plaintiff manufactured, shipped, and delivered to buyers outside the U.S. and thus that defendant did not directly infringe plaintiff's patents, is: 1) reaffirmed as to the summary judgment of no direct infringement and all aspects of the cross-appeal; and 2) vacated as to the District Court's unenhanced damages award with respect to products that were delivered in the United States, where it applied the Seagate test in declining to enhance damages.
