Verinata Health, Inc. v. Ariosa Diagnostics, Inc., 2015-1970

In a dispute involving the enforceability of an arbitration clause in a supply agreement between the parties, that was invoked by plaintiff in response to defendant's counter claim for breach of contract after plaintiff filed a patent infringement suit, the District Court's denial of plaintiff's motion to compel arbitration is affirmed where defendant's counter claims are not subject to arbitration because they relate to patent infringement matters which are unambiguously not subject to mandatory arbitration.
