Howmedica Osteonics Corp. v. Zimmer, Inc., 2015-1232
In an infringement case concerning a socket assembly used in prosthetic hip implants, the District Court's final judgment that defendant did not infringe the asserted claims of the patent and grant of summary judgment of non-infringement following claim construction are affirmed where: 1) the district court did not err in its claim constructions; and 2) did not err in precluding plaintiffs from pursuing a DOE theory of infringement.
