Rembrant Vision Technologies, L.P. v. Johnson & Johnson Vision Care, Inc., 2015-1079

In an infringement action involving a patent related to contact lenses, in which the jury returned a verdict of noninfringement and the district court, in the alternative, granted judgment as a matter of law (JMOL) that plaintiff failed to prove that the accused lenses were 'soft', the district court’s denial of plaintiff's motion for a new trial under Federal Rules of Civil Procedure 60(b)(2) and (3) is reversed where the court abused its discretion in denying Rembrandt's Rule 60(b)(3) motion.
