Moriarty v. Sec'y of Health and Human Servs., 2015-5072

In a petition action for compensation under the National Childhood Vaccine Injury Compensation Program, 42 U.S.C. section 300aa-1 to -34 (2006), the judgment of the Court of Federal Claims that affirmed a special master's decision denying the petition is vacated and remanded for further proceedings where the special master's error in not considering relevant evidence with respect to Althen prong one affects his analysis with respect to prong two as well.
