Canava v. Dep't of Homeland Security, 2015-3083

In an appeal brought by a former U.S. Border Patrol Agent's challenging his removal pursuant to 5 U.S.C. section 7371, which mandates the removal of any law enforcement officer who is convicted of a felony, an arbitrator's decision upholding the removal is affirmed where the arbitrator did not err in finding that plaintiff was convicted of a felony for purposes of 5 U.S.C. section 7371.
