Hicks v. Merit Sys. Prot. Bd., 2016-1091
In an appeal of the final decision of the Merit Systems Protection Board dismissing her individual right of action (IRA) appeal for lack of jurisdiction, brought by a former secretary at an Air Force base who was removed in 1989 from her position for failure to request leave in accordance with proper procedures and being absent without official leave, the Board's decision is affirmed where the Whistleblower Protection Enhancement Act of 2012 (WPEA) did not apply retroactively to afford plaintiff an IRA appeal right based on retaliation that occurred more than two decades before the effective date of the WPEA.
