In a patent infringement action against Samsung Electronics Co., seeking a a writ of mandamus directing the district court to withdraw its order compelling the production of Queen's University's communications with its non-attorney patent agents on grounds that the communications are privileged, the writ petition is granted where consistent with Rule 501 of the Federal Rules of Evidence, a patent-agent privilege is justified, and the court recognizes a patent-agent privilege extending to communications with non-attorney patent agents when those agents are acting within the agent's authorized practice of law before the Patent Office.
