UltimatePointer, LLC v. Nintendo Co., Ltd., 2015-1297

In an infringement action related to a patent describing a handheld pointing device that can be used to control the cursor on a projected computer screen, thereby improving a presenter's ability to control the cursor while making a presentation to an audience, the district court's summary judgment, that defendant did not infringe certain claims of plaintiff's patent and that certain claims are invalid as indefinite, is: 1) affirmed as to the judgment of noninfringement; and 2) reversed as to the determination of indefiniteness.
