In appeals arising from covered Business Method (CBM) reviews of five patents owned by plaintiff that are all related and generally describe a peer-to-peer advertising system that uses mobile communication devices, the United States Patent and Trademark Office, Patent Trial and Appeal Board's decision is: 1) affirmed-in-part as to the Board's conclusions that Paul anticipates the challenged claims of the plaintiff's patents and that the Ratsimor Reference is not a printed publication within the meaning of 35 U.S.C. section 102(b); and 2) reversed-in-part as to the Board's conclusion that the claim terms "endorsement tag" and "token," as used in the '516 patent lack written description support.
