In an appeal of a preliminary injunction barring defendant from supplying distributors with artificial candle products that infringe Disney Enterprises, Inc.'s U.S. Patent, the district court's grant of injunction is reversed and remanded for further proceedings where: 1) plaintiff has standing to sue without joining Disney in the suit; and 2) defendant's argument that the '455 patent anticipates claim 1 of the '166 patent raises a substantial question of validity.
