The Ohio Willow Wood Co. v. Alps South, LLC, 2015-1132

In the latest installment of a long-running dispute between two manufacturers of prosthetic limb accessories, brought by the owner of a group of patents directed to cushioning devices that fit over the residual stumps of amputated limbs to make the use of prosthetics more comfortable, the district court’s judgment is: 1) affirmed as to its decision that the '237 patent is unenforceable for inequitable conduct in connection with the second reexamination, but not in connection with the first; and 2) affirmed as to the district court's decisions with respect to the appropriate remedy.
