Hayden v. Dep't of the Air Force, 2015-3073
In a petition seeking review of the Merit Systems Protection Board decision denying his request for corrective action under the Uniformed Services Employment and Reemployment Rights Act of 1994 (USERRA), 38 U.S.C. section 4301, et. seq., the Board's decision is vacated and remanded for further factfinding where it erred in finding that petitioner failed to meet his burden of proof with respect to his reemployment and retaliation claims.
