United States Federal Circuit

Akzo Nobel Coatings, Inc. v. Dow Chem. Co., 2015-1331

In consolidated appeals in an infringement action relating to a patent directed to an extrusion process that generates low viscosity aqueous polymer dispersions, the district court's grant of summary judgment to defendant is affirmed where defendant did not infringe the claims of the patent either literally or under the doctrine of equivalents. In defendant's cross-appeal, the court's conclusion that the claims of the patent are not indefinite is affirmed where the district court correctly concluded the patent was indefinite.
