In re Urbanski, 2015-1272

In an appeal from the decision of the United States Patent and Trademark Office Patent Trial and Appeal Board affirming the examiner’s rejection of certain claims of a patent directed to a method of enzymatic hydrolysis of soy fiber, such that the product has a reduced water holding capacity suitable for use as food additives, is affirmed where the Board did not err in concluding that the claims of the application would have been obvious over the cited references, and therefore unpatentable under 35 U.S.C. section 103(a) (2006).
