Haggart v. Woodley, 2014-5106

In a challenge to the decision of the United States Court of Federal Claims approving a settlement agreement in a class action takings suit and awarding attorney fees to class counsel under the common fund doctrine, both issues are reversed and remanded where: 1) class counsel failed to disclose how it calculated the individual compensation amount; 2) the common fund doctrine is applicable to RCFC 23 class actions; and 3) recovery of attorney fees under the common fund doctrine is preempted by the under section 304(c) of the Uniform Relocation Assistance and Real Property Acquisition Policies Act of 1970 (URA), 42 U.S.C. section 4654(c).
