Guardian Angels Med. Serv. Dogs, Inc. v. US, 2015-5058

In a dispute arising out of a government contract to provide service dogs to disabled veterans and to provide health insurance for the dogs, the U.S. Federal Claims Court's dismissal of the claim as time-barred is reversed and remanded where: 1) under the facts of this case, we hold that whether the contracting officer 'spends time' considering the request is not the proper standard for calculating time; and 2) plaintiff submitted its complaint to the Court of Federal Claims within twelve months of the VA's May 2013 final decision, thus its suit was timely filed.
