Wi-LAN, Inc. v. Apple, Inc., 2014-1437

In an infringement action involving a patent concerning a wireless data communication technique called Multi-Code Direct-Sequence Spread Spectrum (MC-DSSS), plaintiff's appeal of the trial court’s denial of judgment as a matter of law (JMOL) and its motion for a new trial on infringement, and defendant's cross-appeals of the grant of JMOL of no invalidity are: 1) affirmed as to the jury’s verdict of non-infringement where it was supported by substantial evidence; and 2) reversed as to grant of JMOL of no validity where the trial court's JMOL determination of no invalidity was based on a post-verdict reconstruction of the claims.
