Merck & Cie v. Gnosis S.P.A., 2014-1779

In an appeal from the Patent Trial and Appeal Board's decision that the contested claims of plaintiff's patent are invalid for obviousness, are affirmed over challenges that the prior art taught away from the claimed method, and that objective indicia of non-obviousness further support the patentability of the claims where the Board's factual findings to the contrary were supported by substantial evidence and because we agree with the Board's ultimate conclusion of obviousness.
