Apple, Inc. v. Samsung Electronics Co., Ltd., 2014-1802
In an alleging infringement of five patents directed to smartphone and tablet interfaces, the district court's order denying Apple's request for a permanent injunction, that would bar Samsung from making, using, selling, developing, advertising, or importing into the United States software or code capable of implementing the infringing features in its products, is vacated and remanded where: 1) district court erred when it found the first two eBay factors weighed against an injunction; 2) Apple has established that the harm it will suffer is not easily compensable at law; and 3) the balance of hardships and public interest weigh strongly in favor of an injunction.
