In the government's appeal of the United States Court of International Trade (CIT) judgment dismissing the government’s penalty claim based on negligence for failure to exhaust the administrative remedies under 19 U.S.C. section 1592, the CIT decision is affirmed where the statutory framework of section 1592 does not allow the government to change the culpability level that Customs alleged in the penalty claim.
