Arisosa Diagnostic v. Verinata Health, Inc., 15-1215

In an appeal of an interpartes review in an infringement action involving a patent for noninvasive prenatal testing for the presence of fetal chromosomal abnormalities, in particular a method that may identify a Down Syndrome characteristic, the decision of the Patent Trial and Appeal Board finding nonobviousness is vacated and remanded for further consideration where the Board's language suggests it did not sufficiently consider one issue.
