Akami Technologies, Inc. v. Limelight Networks, Inc., 09-1372
In an infringement case involving ubiquitous internet network technology, the en banc's reversal of the district court's grant of JMOL of non-infringement is affirmed where: 1) the district court did not err in its claim constructions and appropriately instructed the jury; and 2) there was no error in the district court's disallowance of Akami's lost profits expert.
