Inphi Corp. v. Netlist, Inc., 15-1179
In an appeal of an inter partes reexamination of a patent related to computer system memory modules, in which the examiner first rejected certain claims and then withdrew them after Netlist amended its claims by narrowing them, the Patent Trial and Appeal Board decision affirming the examiner's final decision is affirmed where the Board's determination that the negative claim limitation met the requirements of 35 U.S. C. section 112, paragraph 1 (2006) is supported by substantial evidence.
