In an action appealing inter partes review of a patent which discloses and claims a method for making a communications cable, the Patent and Trademark Office's Patent Trail and Appeal Board's mixed decision rejecting certain claims while confirming certain claims is: 1) affirmed as to the rejection of claims 1-4, where they would have been obvious; and 2) reversed as to the upholding of claims 5 and 6, where they, too, would have been obvious.
