Atlas IP, LLC v. St. Jude Medical, Inc., 15-1190
In an infringement action involving a patent which describes and claims a protocol for controlling wireless network communications between a hub and remotes, the district court's grant of summary judgments of non-infringement is vacated and remanded for further proceedings where: 1) the court erred in construing the "transmitting" limitation to require that the starting time and duration of a communication cycle be sent in advance of the communication cycle; and 2) there is no ruling about infringement under any other claim construction.
