In an infringement case involving a patent related to the processing of digital content, alleging that that the process of sending photographs via the multimedia messaging service (MMS) as used by smartphones and tablets designed, manufactured, and sold by defendant infringes the patent, the jury verdict's fining the patent not invalid and infringed and the district court's denial of defendant's pre-verdict JMOL of no indirect infringement are affirmed where the district court correctly constructed the claim and the jury verdict was proper.
