Apple, Inc. v. Samsung Electronics Co., Ltd., 14-1802

In an infringement suit involving five patents directed to smartphone and tabled interfaces, the district court's order, denying plaintiff's post-verdict request for a permanent injunction barring defendant from making, using, selling, developing, advertising or importing into the U.S. software or code capable of implementing the infringing features in its products, is vacated where the court erred when it found the first two "eBay" factors weighed against an injunction, eBay Inc. v. MercExchange, L.L.C., 547 U.S. 388, 395 (2006).
