United States Federal Circuit

Ivera Medical Corp. v. Hospira, Inc., 14-1613

In an infringement suit involving three patents that share the same written description, which relate to a cleaning device to be used to reduce transmissions of pathogens into patients when using medical implements such as catheters and luer ports, the district court's summary judgment of invalidity, finding the asserted patent claims obvious under 35 U.S.C. section 103, is reversed where plaintiff established a genuine dispute over whether one of ordinary skill in the art would have been motivated to add a vent to the disinfecting cap described in a previously registered patent.
