The Dow Chemical Corp. v. NOVA Chemicals Corp., 14-1431

In an infringement suit involving a patents direct to ethylene polymer compositions (a type of plastic) with improved modulus, yield strength, impact strength and tear strength, the district court's grant of supplemental damages in the form of lost profits and reasonable royalties is reversed where, under the standard articulated by the US Supreme Court in Nautilus v. Biosig Instruments, Inc., 134 S. Ct. 2120 (2014), the claims are indefinite.
