United States Federal Circuit

Hyatt v. Lee, 14-1596

In a suit under the Administrative Procedure Act (APA) against the Patent and Trademark Office (PTO) and its acting director under 5 U.S.C. section 701(a)(2), the district court's decision that it lacked subject matter jurisdiction over the claims is affirmed on the alternative grounds that the PTO would have been entitled to summary judgment for these claims.
