Akami Techs., Inc. v. Limelight Networks, Inc., 09-1372

In an infringement action relating to a patent which claims methods for delivering content over the Internet, on remand from the US Supreme Court, and setting forth the law of divided infringement under 35 U.S.C. section 271(a), which occurs where all steps of a claimed method are performed by or attributable to a single entity, the district court's judgment of noninfringement as a matter of law is reversed where substantial evidence supports the jury's finding that defendant directly infringes a patent. Where more than one actor is involved in practicing the steps, a court must determine whether the acts of one are attributable to the other such that a single entity is responsible for the infringement.
