Allergran, Inc. v. Sandoz, Inc., 14-1275

In an suit against makers of generic versions of a patented drugs used in glaucoma treatment, alleging the generic makers' Abbreviated New Drug Application (ANDA) to the FDA infringed the patents, the findings of the district court judgment in favor of plaintiff are affirmed where: 1) the patents were not show to be invalid for obviousness under 35 U.S.C. section 103; 2) certain claims of the patents were not shown to be invalid for lack of an adequate written description under 35 U.S.C. section 112; 3) certain claims were not shown to be invalid for lack of enablement under section 112; and 4) defendant infringed certain patent claims literally and under the doctrine of equivalents.
