Carter v. McDonald, 14-7122

In a veterans' benefits case in which plaintiff had the opportunity to submit additional evidence for his appeal, but the Board of Veterans' Appeals then failed to give proper notice of the Board-set deadline for filing such evidence, the Veterans Court's decision affirming the Board's denial is vacated and remanded for plaintiff to have the opportunity to submit his new evidence, where the Veterans Court had an incorrect understanding of the law governing the notice defect in this case.
